Terms of Service — Fluency Refrain

1. Who we are and what these terms cover
Fluency Refrain is an iPhone app for collecting spoken phrases in the languages you’re learning and practising them by chorusing — repeating each phrase along with a recorded voice — and spaced repetition. It is operated by Noble Fluency LLC (“we,” “us,” “Fluency Refrain”). By installing or using the app, you agree to these Terms of Service. If you do not agree, do not use the app. You can reach us at support@fluencyrefrain.com.
2. The service
Fluency Refrain lets you build a personal collection of phrases, hear them spoken by a synthesized native-speaker voice, drill them as flashcards, and chorus them at an adjustable tempo. Some features — phrase suggestions, filling in a phrase from one line, and importing phrases from text, PDFs, or photos — are generated automatically by a third-party AI model and may contain errors: a suggested phrase may be unidiomatic, mistranslated, or wrong for the variety of the language you’re learning. Synthesized audio may mispronounce words. The app supports 80+ languages, and quality varies between them. The app is intended to support language learning and is not professional, educational, or other expert advice. You are responsible for how you use it.
There are no accounts. Your content is stored on your device and is your responsibility to back up; the app provides an export for this purpose. We hold no copy of it and cannot restore it for you.
3. Eligibility
You must be at least 16 years old to use Fluency Refrain.
4. Free use and Refrain Pro
Free. Without a subscription you can use every feature of the app with up to 20 phrases across all of your languages.
Refrain Pro. A Refrain Pro subscription removes the phrase limit. Nothing else differs. Pro is sold as an auto-renewing in-app subscription through Apple’s App Store; the plans available, their prices, and any free-trial period are shown in the app and in the App Store at the time of purchase. Prices are in your local currency as set by Apple and may change with notice; changes will not affect your current billing period.
Billing and renewal. Payment is charged to your Apple ID at confirmation of purchase. A subscription renews automatically at the end of each period unless cancelled at least 24 hours before it ends. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
5. Cancellation and refunds
Cancellation. You can cancel at any time in your Apple ID subscription settings. Your subscription stays active until the end of the current period and does not renew. Deleting the app does not cancel a subscription.
Refunds. Because purchases are made through the App Store, refunds are handled by Apple under Apple’s refund policy. Request one at reportaproblem.apple.com. We cannot issue refunds directly, but if something has gone wrong, email support@fluencyrefrain.com and we will help.
6. Your content
You keep ownership of the phrases, notes, and other content you add to the app (“your content”). You grant us the limited rights needed to operate the service — to send your content to our speech and AI providers to generate audio and suggestions, and to return the results to you — as described in our Privacy Policy. You are responsible for your content and must have the right to use it.
7. Acceptable use
You agree not to: use the app unlawfully; attempt to disrupt, reverse-engineer, or gain unauthorized access to the app or the servers behind it; extract or misuse the credentials the app uses to reach our services; or use the AI features to generate content that is illegal or infringes others’ rights. We enforce daily per-device limits on speech and AI requests to keep the service fair; a device that persistently abuses the service may be blocked.
8. AI-generated content and synthesized speech
Suggestions, translations, transliterations, and extracted phrases are produced by an automated AI system, and spoken audio is produced by a text-to-speech system. Both are provided “as is.” They may be incomplete, inaccurate, or unsuitable for a given purpose. We make no warranty about the accuracy of any phrase, translation, or pronunciation, and you should not rely on them as a substitute for qualified instruction.
9. Service availability and changes
We may modify, suspend, or discontinue features at any time. Speech and AI features depend on third-party providers and may be unavailable from time to time; when a native-speaker voice is unavailable the app falls back to your phone’s built-in voice. We aim to keep the service available but do not guarantee uninterrupted or error-free operation. During the beta period in particular, features may change and data formats may evolve.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the app is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Noble Fluency LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Termination
You may stop using the app at any time by deleting it. We may suspend or terminate your access to our services if you breach these terms or to comply with law. Sections that by their nature should survive termination (such as content rights granted, disclaimers, and limitation of liability) will survive.
12. Apple
These terms are between you and Noble Fluency LLC, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Disputes will be subject to the courts located in Washington State, unless applicable law provides otherwise.
14. Changes to these terms
We may update these terms. Material changes will be reflected in the effective date above and, where appropriate, communicated in the app. Continued use after changes take effect constitutes acceptance.
